Scope of legislation

This ESSENTIAL describes the legal obligations for manufacturers and the regulatory requirements for equipment as specified in the technical regulation.
Article 1: 1. This Regulation applies to equipment which is liable to cause electromagnetic disturbance or whose operation is liable to be affected by such disturbance.
2. This Regulation lays down rules: a. the offering, making available on the market, installation, construction and use of equipment. b. the acceptance of testing and conformity assessment bodies. c. the inspection of the equipment.
Article 2: a. ‘equipment’ means any apparatus or fixed installation. b. ‘apparatus’: b1. A finished apparatus, or a combination of such apparatus made available on the market as a functional unit, intended for the end user, which is liable to generate electromagnetic disturbance or whose functioning may be affected by electromagnetic disturbance. b2. Any component or sub-assembly intended to be incorporated into such apparatus by the end user which is liable to generate electromagnetic disturbance or whose functioning is liable to be affected by such disturbance. b3. Any combination of such apparatus and, where appropriate, other apparatus which is mobile and intended for use in different locations (mobile installation).'
