Legislation in force: The applicable legislation is the so-called Industrials Chemicals Act 2019 which is mandatory since 1 July 2020. The Australian Industrial Chemicals Introduction Scheme (AICIS) replaced the National Industrial Chemicals Notification and Assessment Scheme (NICNAS) on 1 July 2020 as the new national regulator of the importation and manufacture of industrial chemicals in Australia. These rules implement details of the new regulatory scheme for the introduction of industrial chemicals enacted by the Industrial Chemicals Act 2019 and the Industrial Chemicals (Consequential Amendments and Transitional Provisions) Act 2019.

Scope of legislation
Section 9 of the Act
"article" means an object that:
(a) is produced for use for a particular purpose, being a purpose that requires that the object have a particular shape, surface or design; and
(b) is formed to that shape, surface or design during production; and
(c) undergoes no change of chemical composition when used for that purpose except as an intrinsic aspect of that use;
but does not include an object of a kind prescribed by the rules for the purposes of this definition.

"use", for an industrial chemical, includes any of the following activities involving the industrial chemical:
(j) producing an article;

Specified classes of introductions
(4) For the purposes of subsection (1), this subsection applies to the following classes of introductions:
(a) introductions of an industrial chemical that is a UV filter;
(b) introductions of an industrial chemical for an end use in an article with food contact;
(c) introductions of an industrial chemical for an end use in a personal vaporiser;
(d) introductions of an industrial chemical for an end use in tattoo ink;
(e) introductions of an industrial chemical for an end use in an article that is a children’s toy or a children’s care product.'
